These Terms of Service ("Terms") govern your access to and use of the Luna Chatting website at lunachatting.com and the Luna desktop application (together, the "Service"). By creating an account, activating a license, or otherwise using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract. You confirm that any content, likeness, or voice samples you provide are yours to use and that you have the rights to configure them into the Service.
2. The Service
Luna is a warm-up chatbot for creators. It mirrors your configured tone and style, keeps fan conversations warm when you are offline, detects buying intent, and sends you a Telegram alert when a lead is ready. Luna does not close sales or deliver paid content. Final closing is performed by you.
3. Trial, licenses, and billing
- Trial: a free 7-day trial is available upon activation with the team.
- Licenses: 1-month at $100, 6-month at $480 (20% discount), 1-year at $840 (30% discount, billable upfront or in two $420 installments).
- Commission: all plans include a 7% commission model, billed as described at activation.
- Licenses are activated manually by the team after the trial. Exact billing cadence and refund terms are confirmed in writing at activation.
4. License grant
During the paid term, Luna Chatting grants you a limited, non-exclusive, non-transferable license to install and use the Luna desktop application and access the Service for your own creator operations. You may not sublicense, resell, reverse-engineer, or distribute the Service, and you may not use it on behalf of third parties outside your own creator brand.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, deceptive, or abusive purposes.
- Impersonate another person without their explicit consent.
- Configure Luna to target minors or to produce content involving minors.
- Circumvent any rate limits, access controls, or technical protections.
- Introduce malicious code or interfere with the stability of the Service.
6. Creator obligations
- You are solely responsible for the tone, phrases, and style configured into Luna.
- You remain responsible for the sale-closing step. Luna handles warm-up only.
- You are responsible for complying with the terms of any third-party platform you operate on (for example, OnlyFans) and any applicable local laws.
- You must keep your account credentials confidential.
7. Intellectual property
Luna Chatting owns the Service, including the software, the Luna brand, documentation, and all improvements. Content you configure into the Service — your voice samples, phrases, handoff rules, and conversation logs — remains your property. You grant us a limited license to process that content as needed to operate the Service.
8. Fees, taxes, and refunds
Fees are quoted in US dollars unless otherwise stated. You are responsible for any taxes that apply in your jurisdiction. Trial-period cancellations incur no charge. Refund policy for mid-term cancellations will be confirmed in the final published version of these Terms.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, non-infringement, and uninterrupted availability. Generative AI output may occasionally produce unexpected results; you remain responsible for reviewing conversations and the handoff threshold you configure.
10. Limitation of liability
To the maximum extent permitted by law, Luna Chatting and its affiliates are not liable for indirect, incidental, consequential, special, or exemplary damages, including lost revenue, lost data, or reputational harm. Our total aggregate liability to you under these Terms will not exceed the fees you paid for the Service in the twelve months preceding the event giving rise to the claim.
11. Termination
We may suspend or terminate your access for material breach of these Terms, non-payment, or misuse. You may cancel at any time by contacting support. Upon termination, your license rights end and we may retain data as described in the Privacy Policy.
12. Governing law and disputes
These Terms are governed by the laws of [Jurisdiction to be confirmed with legal]. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer-protection rules require otherwise.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after the effective date of an update constitutes acceptance of the revised Terms.
